Terms and Conditions

Linnik
Design (also referred to as “we”, “us” and “the designer”) agrees to provide
design services to the individual or organisation (referred to as “the
client”) as agreed in writing following discussion with the client.

An initial
payment equal to 20% of the agreed price is due on approval of the sample
design. Work on the final design will not commence until this payment has
been received. On completion of design services the client will receive
an invoice for the remaining 80% plus any fees for additonal features agreed
during the design process. This will be due for payment within 14
days of submission. Web sites will not be released to the client until
this payment has been received.

On receipt
of the final payment the client will be provided with a CD-ROM containing
all files comprising the completed design. Web sites can be uploaded
to the client's webhost at this time.

Completed
websites become the property of the client, subject to all accounts being
paid, with the restriction that no portion of the coding can be copied
/ duplicated or redistributed in any form electronic or otherwise without
the written agreement of the designer.

We reserve
the right to charge a cancellation fee should the client cancel design
services prior to completion. Any such fee will cover the cost of work
completed up to the point of cancellation.

We reserve
the right to withdraw our services at our discretion. Should we exercise
this right Linnik Design shall be under no liability whatsoever to the
client for any costs, losses and damages, howsoever arising, that the client
may incur or may have incurred.

In the
event of a problem relating to the design of any website designed by us
we will endeavor to solve the problem as quickly as possible. Linnik
Design cannot accept responsibility for any loss either monetary or otherwise
due to web site failure or misuse.

Linnik
Design does not provide services such as domain name registration and hosting.
We may provide advice to clients in obtaining such services, however, we
cannot make guarantees of service on behalf of third parties and cannot
be held responsible for failure of any service provided by them.

If we
agree a timescale with the client for completion of design service then
that time shall not commence until we have received approval of the sample
designs together with the initial payment and any content that is to be
provided by the client. Should we need to extend timescales due to
circumstances beyond our control we will notify you as soon as possible.

We reserve
the right to place a link to the Linnik Design website from any site that
we design. This link must remain in place for a minimum of 12 months
from the date of completion.

We reserve
the right to place a link from the Linnik Design website to any site that
we design.

We will
respect the privacy of our clients. We will not pass on client's
details to any third party without their consent unless required to do
so by law. Client's details will not be added to mailing lists without
their agreement.

Linnik
Design makes no warranties of any kind, express or implied, for any and
all products and/or services that it supplies and will not be held responsible
for any and all damages resulting from the same.

Linnik
Design is not responsible for any loss, or consequential loss of data,
or non-delivery of products or services, of whatever cause. The client
agrees not to hold Linnik Design responsible for any such loss or damage.
Any claim against Linnik Design shall be limited to the relevant fee(s)
paid by the client.
We
endeavor to ensure that all information displayed on our website is accurate
and up-to-date, however, the information provided is as is and Linnik Design
cannot be held responsible for any actions made based upon the said information.
